Fulton County GA Indictments to Be Announced by midnight Eastern time
I’ve been silent for 6 weeks due to packing and moving, which is now 90% complete. But I have to weigh in about this historic moment.
The Grand Jury supposedly returned ten indictments. Likely to be made public by no later than 12:30 a.m. Eastern time.
My best guessing here of the ten charged (unless I misunderstand and it’s ten charges directed at Trump with others to be indicted later):
Trump
Atty John Eastman, who came up with the fake elector idea
Atty Rudy Giuliani
Atty Sidney Powell…. Sidney & Rudy for the elections data breach in Coffee County
Misty Hampton, the local Coffee County official who invited that breach team in.
5 fake electors
Charges will include conspiracy, racketeering and rights violations.
It's possible that Trump Chief of Staff Mark Meadows will be one of the ten and that some fake electors gained immunity by providing important testimony.
The jury approved all the indictments presented to them.
And the charges are announced before I finished.
Of the 19 people indicted, at least 8 are lawyers, two were GA election officials and a third used to be a Philly election official. The other 8 include Trump and his chief of staff, a publicist, a bail bondsman, a pastor, the head of Black Voices For Trump, a GA GOP chair, a Coffee County GOP chair and one fake elector.
I scribbled notes about them from the court list of alleged conspirators.
At least 3 were involved in the Coffee County elections breach, another 3 were involved with intimidating election officials and most of the others were involved in the fake electors scams.
All 19 have 11 days to turn themselves in.
It’s alleged that all 19 violated Georgia’s Racketeering Act.
Shafer, Still and Latham are charged with impersonating a public officer (apparently to gain access to the Coffee County election data).
Trump, Roman (the Philly election official who organized the fake electors in multiple states), the attorneys Giuliani, Eastman, Chesebro, Smith III, and Cheeley are charged with Conspiracy to Commit to Impersonating a Public Officer, but Shafer/Still/Latham aren’t charged with this conspiracy, so apparently Michael Roman’s organizing fake electoral slates is the centerpiece of this conspiracy charge.
Conspiracy To Commit False Statements & Writings (#13, 19) was charged to Trump, Giuliani, Smith III, Eastman, Chesebro, Cheeley and Roman. (6 of the 8 lawyers).
False Statements & Writings, (#3, 4, 7, 12, 18, 24, 25, 26, 29, 39 and 40), includes Trump (29/39), Giuliani (3/7/24), Smith III (4/25), Cheeley (26), so only 3 lawyers here. Then GA GOP chair & fake elector Shafer (12/18/40), fake elector Still (12/18) and Coffee County GOP Chair Latham (12/18) must have been lying about the data breach in Coffee County.
Criminal Attempt To Commit False Statements & Writings (#22) DOJ official Jeffrey Bossert Clark is the sole one charged with this.
Solicitation of Violation of Oath by a Public Officer (#2, 5, 6, 23, 28, 38) was only charged to Trump (5/28/38), Giuliani (6/23), Eastman (2), Smith (2/6/23), and Cheeley (23). And Meadows (28) (his only charge other than racketeering) and Jenna Ellis (2) (her only charge besides racketeering). I presume this includes Trump’s call to the GA Secretary of State, asking him to find a specific number of votes.
Forgery In the First Degree (#10, 16) Shafer, Still, and Latham are charged with this, but not as members of the conspiracy. Shafer & Still were charged with two counts of this forgery.
Conspiracy to Commit Forgery in the First Degree (#11, 17) Trump, Giuliani, Eastman, Chesebro, Smith III, Cheeley, and Roman apparently influenced the 3 who did it.
Filing False Documents (#27) Only Trump and Eastman had this charge.
Criminal Attempt To Commit Filing False Documents (#14) Still, Latham and Shafer, same as the Forgery
Conspiracy To Commit Filing False Documents (#15) Trump, Giuliani, Eastman, Chesebro, Smith III, Cheeley and Roman, same as the Forgery Conspiracy.
Criminal Attempt To Commit Influencing Witnesses (#20, 21) The Pastor, Stephen Cliffgard Lee, is the sole person indicted for this.
Influencing Witnesses (#31) The Pastor, Stephen Cliffgard Lee, plus the head of Black Voices For Trump Harrison William Prescott Floyd, and Publicist Trevian C. Kutti were charged with this.
Conspiracy To Commit Election Fraud (#32, 33) Attorney Sidney Powell, Coffee County members Latham & Hampton, plus Bail Bondsman Hall are charged for this. And for Conspiracy To Commit Computer Theft (#34), Conspiracy To Commit Computer Trespass (#35), Conspiracy To Commit Computer Invasion Of Privacy (#36) and Conspiracy To Defraud the State (#37).
Perjury (#41) is charged only to Atty Cheeley.
Trump (13 charges), Giuliani (13 charges), Smith III (12 charges), Latham (11), Cheeley (10), Eastnan (9) and Shafer (8), face the most charges. Chesebro, Roman, Still, Powell, Hall, and Hampton each face 7. Only 6 defendants have fewer charges.
There are also another 30 unindicted co-conspirators, so 49 people in all.
Per CNN:
Prosecutors say the criminal actions the charge is built around include: making false statements, filing false documents and forgeries, impersonating officials, computer breaches and attempts to influence witnesses.
Major events that built the case include how Trump’s team allegedly misled state officials in Georgia, organized fake electors, harassed election worker Ruby Freeman and breached election equipment in a rural Georgia County.
Several of the acts alleged to have made up the racketeering conspiracy involved states other than Georgia. At Monday’s late night press conference, Willis explained that the grand jury saw the out-of-state conduct highlighted in the indictment as being part of the plot to overturn Georgia’s 2020 results.
Among the 161 alleged acts that indictment alleges were done in furtherance of the alleged conspiracy to reverse Trump’s electoral loss were the several episodes of outreach from Trump and his advisers to state legislators in Pennsylvania, Michigan and Arizona. The indictment also highlighted the effort to organize fake electors in Wisconsin, Arizona and other states, in addition to the coordination of an alternative slate of electors in Georgia.
The pressure campaign on Vice President Mike Pence to disrupt Congress’ certification of the 2020 results also plays a large role in the indictment.
DA Fani Willis intends to try all 19 defendants together instead of 19 different trials. With a jury, 19 defendants, more than 21 defense attorneys plus witnesses and the press, that’ll be one crowded courtroom.
